Fidelis Law Responds to the Law Society of New Brunswick’s new Contingent Fee Rules
MONCTON, NB – The Law Society of New Brunswick announced changes to the Contingent Fee Rules that come into force as of today, October 1, 2021. These changes increase the maximum contingent fee from 25% to 33% of the amount recovered in a settlement or judgement.
Fidelis Law believes this is a substantial change that will have an impact on access to justice for New Brunswickers. This new maximum fee will allow individuals to gain representation in areas of law where lawyers were traditionally unwilling to take the case at a 25% rate. However, this was not the case with most motor vehicle, cyclist, or pedestrian accidents. Therefore, in the vast majority of cases we take, Fidelis will not be charging the new maximum established by these rules.
“Fidelis believes that in most cases involving a motor vehicle accident, a cyclist accident, or a pedestrian accident, a lawyer would be adequately compensated with a 25% fee,” says Mathieu Picard, a founding partner of Fidelis Law. “Our goal has and always will be to ensure access to justice for all New Brunswickers who have been wronged by someone else’s negligence. Our team of lawyers will continue to help our clients who have been injured, support them while they recover, and protect them from insurance companies without necessarily charging this new maximum fee.”
The new rules also stipulate that a new “Know Your Rights” booklet be made available to all clients. An electronic version of the booklet can be found at www.fidelislaw.ca/knowyourrights, or anyone can obtain a paper copy from the Fidelis Law offices.
